Welcome to the Wacom Singapore Pte. Ltd. (“Wacom,” “we,” or “us”) eStore which is accessible via the following link: http://estore.wacom.com. 

PLEASE READ THE FOLLOWING TERMS OF SALE (“TERMS”) CAREFULLY PRIOR TO MAKING A PURCHASE THROUGH THE WACOM ESTORE. BY MAKING A PURCHASE THROUGH THE ESTORE, YOU AGREE TO BE BOUND BY THESE TERMS, IN ADDITION TO OUR TERMS OF USE, WHICH ARE INCORPORATED HEREIN BY THIS REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT MAKE A PURCHASE FROM THE ESTORE.

These Terms apply to your purchase of any Products from Wacom through the eStore, except to the extent you have entered into a separate written agreement with Wacom that supersedes these Terms. For purposes of these terms, “Product(s)” refers both to Wacom’s own hardware or software products (including software provided as a service), in addition to third party hardware or software products (including software provided as a service) that Wacom sells through the eStore, as applicable.

Certain Products may also be accompanied by other Wacom or third party terms and conditions. (“Product Specific Terms”) specifying the terms and conditions under which Products are being offered (which may include, by way of illustration, subscription terms or license restrictions).  Where Product Specific Terms are provided, the particular Product Specific Terms also apply to your purchase of the products offered under the applicable Product Specific Terms.

These Terms are subject to change without prior notice to you, at any time in Wacom’s sole discretion. We encourage you to review these Terms each time you make a purchase from us, as the version of these Terms in effect at the time of your purchase shall apply to that purchase.

You acknowledge that any products which you purchased from Wacom through the eStore will be shipped only to Singapore, Malaysia, Indonesia, Philippines, Thailand and Vietnam.

1. Availability and Pricing

All Products offered for sale through the eStore are subject to availability, and any order you place through the eStore is subject to acceptance by Wacom, as determined in its sole and absolute discretion. Among other things, Wacom reserves the right to impose quantity limits on any order, reject all or any part of any order, or even discontinue any Product or the eStore altogether without prior notice to you.

Prices are subject to change at any time, but any such changes will not affect any product order that you have already placed through the eStore.

3. Product Information and Errors

The images of the products on our eStore are for illustrative purposes only.

Wacom uses commercially reasonable efforts so as to minimize errors in any Product descriptions, images, pricing or other Product information on the eStore. However Wacom does not warrant that Product descriptions, images, pricing or other Product information displayed on the eStore are accurate, complete, reliable, current, or error-free. In addition, all weights and size dimensions are only approximate.

We may change the product to reflect changes in relevant laws and regulatory requirements and to implement minor technical adjustments and improvements, for example to address a security threat.

If a hardware Product offered on the eStore is not as described or pictured, your sole remedy is to return it in its unused, original condition for a refund in accordance with the terms of our Return Policy. In the event of an error, whether on the eStore, in an order confirmation, in processing an order, or otherwise, Wacom reserves the right to correct such error and charge the correct price or cancel the order, and your sole remedy in the event of such an error is to cancel your order.

4. Shipping; Risk of Loss

5. Returns

Please see our Return Policy for information on Wacom’s return policies and procedures.

6. Software

All software Products, whether sold separately or otherwise pre-installed in or bundled with hardware Products or that are provided as a service by Wacom (or the applicable third party provider), are licensed and not sold by Wacom (or the applicable third party provider). You shall be entitled to use the software in accordance with the end user license or terms of use or terms of service accompanying the software or as otherwise specified herein.  Otherwise, all right, title and interest in and to the software Products are and shall at all times remain the sole and exclusive property of either Wacom (to the extent the software is being licensed or made available to you by Wacom), or by the third party provider, and no other right, title or interest therein or thereto is granted to you, whether by implication, estoppel or otherwise.

The software may be accompanied by Product Specific Terms which may be either included with the software or which you will be provided the opportunity to review and accept as a condition to purchasing license or usage rights from Wacom, or otherwise downloading or installing the software.  If you do not expressly accept the Product Specific Terms when and if provided the opportunity to do so by Wacom or the third party provider (i.e., by clicking “I accept” or otherwise indicating your acceptance of the Product Specific Terms), then you will have no right to receive a license key from Wacom or the third party provider, or to otherwise download, install, access or use the software, and further, you acknowledge and agree that Wacom will have no obligation to refund to you any license fees or other usage fees you have paid in connection with the software. 

The legal agreement regarding your use of the software will be between you and Wacom or between you and the party identified as the “licensor” or third party provider in the Product Specific Terms under which the software is being provided.  Where the software is being provided to you by a third party, you acknowledge and agree that Wacom will not be responsible for, and shall have no liability to you in connection with, any such software.

If no Product Specific Terms are included with or are provided in connection with the software, then you are granted a non-exclusive and non-transferable license to use the software on a single Wacom or other approved device owned by you, solely for your individual use, and not for further resale or distribution. The software may not be retranslated to other code forms (decompiling), returned to previous development stages (reverse engineering), edited, converted, further developed or transferred to another data medium.

7. Warranty Information

Wacom provides certain limited warranties in connection with Wacom Products. For more information on Wacom’s limited warranties, please visit our Limited Warranty page.

Please note that Wacom does not itself warrant any third party Products sold through the eStore.  Rather, the sole warranty for any such third party Products is the warranty provided by the applicable manufacturer or provider of the Product and that accompanies the Product or that is provided as part of the Product Specific Terms for the Product.  Wacom may, in its discretion, provide reasonable assistance to you in making any warranty claims against the applicable manufacturer or provider. 

8. Limitations of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WACOM AND ITS DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, LICENSORS INDEPENDENT CONTRACTORS, SERVICE PROVIDERS AND CONSULTANTS (COLLECTIVELY, THE “WACOM PARTIES”) SHALL NOT BE LIABLE TO YOU UNDER ANY THEORY OF LIABILITY—WHETHER CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE—FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES OF ANY KIND THAT MAY BE INCURRED BY YOU OR ANY THIRD PARTY, ARISING OUT OF OR IN ANY WAY CONNECTED TO THESE TERMS OR THE USE OF, OR INABILITY TO USE, ANY PRODUCT, INCLUDING WITHOUT LIMITATION ANY DAMAGES CAUSED BY OR RESULTING FROM RELIANCE BY YOU ON ANY INFORMATION OR PRODUCTS OBTAINED FROM US, WHETHER OR NOT WACOM OR ANY WACOM PARTY HAS BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH DAMAGES. YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WACOM’S AND THE WACOM PARTIES’ TOTAL LIABILITY TO YOU IN CONNECTION WITH THE PRODUCTS AND THESE TERMS WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID WACOM FOR THE PRODUCT.

SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

9. Governing Law and Dispute Resolution.

You agree that any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (“SIAC”) in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (“SIAC Rules”) for the time being in force, which rules are deemed to be incorporated by reference in this Section. The seat of arbitration shall be Singapore. The tribunal shall consist of three (3) arbitrators. The language of the arbitration shall be English. The arbitration fees and all costs relating to such arbitration (including the legal fees) shall be borne in such proportion as may be determined in the arbitral award. You further agree that any arbitration award shall be final and binding on you.

10. Severability

If any provision of these Terms shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

11. Transfer of Rights

Wacom shall have the right to transfer our rights and obligations under these Terms to another person. We will notify you in writing if this happens.

You may, however, only transfer your rights and obligations under these Terms to another person if we agree to this in writing.

12. No Waiver

No failure on the part of Wacom to exercise, and no delay on our part in exercising, any right or remedy under these Terms shall operate as a waiver thereof, nor will any single or partial exercise of any right or remedy preclude any other further exercise thereof or the exercise of any other right or remedy. Wacom’s rights and remedies provided under these Terms are cumulative and not exclusive of any rights or remedies (whether provided by law or otherwise).

13. Personal Information

We may use your personal information during the course of processing your order and as such, your purchase of the products from our eStore is subject to additional terms, which are set out in our privacy policy. Our privacy policy and information on our use of your personal information is available at https://www.wacom.com/privacy . On the other hand, our use of cookies in collecting and processing personal information is described in Wacom’s Cookie Notice, which is available at https://www.wacom.com/cookie-notice.

14. Language

These Terms shall be governed and construed using the English language. Accordingly, the English version of these Terms controls in the event of any discrepancy with other translated versions of these Terms.

A notice given by or to us or any communication between you and us in connection with your order and these Terms shall be in the English language.

15. No Third Party Rights

These Terms is between you and us. No other person shall have any rights to enforce any of its terms under any applicable law including the Contract (Rights of Third Parties) Act of Singapore unless otherwise expressly provided in these Terms.

16. Force Majeure

We shall not be in breach of these Terms and we shall not be liable for any delay in performing, or failure to perform, any of our obligations under these Terms if such delay or failure results from events, circumstances or causes beyond our reasonable control, including but not limited to, acts of God, natural disaster, epidemic or pandemic, terrorist attack civil war, civil commotion or riots, war, threat of or preparation for war, imposition of sanctions or embargo, collapse of buildings, fire or explosion, or any law or any action taken by a government or public authority, including without limitation, imposing an export or import restriction, quota or prohibition.

In such circumstances we shall be entitled to a reasonable extension of the time for performing such obligations or if the period of delay or non-performance continues for two (2) months, we may, at our sole and absolute discretion, terminate your order and refund the total amount paid for such order.

17. Addendum

Where applicable, the provisions in the Addendum shall apply to the categories of users specified therein. The Addendum shall form an integral part of these Terms and reference to these “Terms” shall include the Addendum. In the event of any inconsistencies between these Terms and the Addendum, the provisions in the Addendum shall prevail only to the extent of such inconsistencies.

SHIPPING DETAILS & TAXES

Hardware orders

Wacom uses parcel delivery service for the shipping of Wacom Products to its customers. We provide the delivery for specific hardware Products based on weight or size. All orders ship from our warehouse in Singapore. Accordingly, all shipments to Malaysia, Indonesia, Philippines, Thailand and Vietnam will be from Wacom’s warehouse in Singapore.

All orders are subject to a one to two Business Days (as defined below) processing period before shipping and for that reason, when selecting your shipping preference, you should add up to two days to the delivery period indicated during the order process. Please note that the delivery period may be affected during holiday periods in Singapore and at the delivery location and/or by relevant custom clearance procedures. While Wacom endeavors to use industry-leading carriers to ship your orders to you, the delivery period is also subject to such carrier’s shipping capacity at the relevant time of your order and as such, may be subject to further delays.

"Business Day", whenever used herein, means a day (excluding Saturday and Sunday) on which banks generally are open for normal banking business in Singapore and such other cities as may be relevant for processing your payment.  

Currently we are only able to accept orders which shipments are intended for Singapore, Malaysia, Indonesia, Philippines, Thailand and Vietnam. Our applicable shipment charges for each order are as follows:

Title (other than title to software, which does not transfer to you but rather is retained by Wacom or the applicable third party provider) and risk of loss or damage to a Product passes to you upon delivery of the product to the carrier which delivers the Product to your specified delivery location.  Wacom is not responsible for any shipping delays or problems once the Product has been shipped.

Software Orders

Orders for Wacom software will be delivered electronically through the use of a license key to be used as part of the initial download of the software Product.  You must obtain a Wacom account for purposes of downloading your software Product.  Software orders will be delivered within 2 to 4 working days’ of Wacom’s acceptance of the relevant order.

Orders for third party software will be delivered pursuant to and in accordance with the Product Specific Terms under which the third party software is being offered

How to Expedite Shipping Your Order and Avoid Delays

As set out above, you may opt for Express Delivery for the shipment of your order by paying the applicable shipment charges.

You can avoid delivery delays by providing accurate and complete information as part of submitting your order. Such information includes your full address, including company name if applicable, address and a valid phone number.

Since we use a third-party address verification system, you should enter your address information exactly as it appears on your credit card billing statement.

Lastly, save time and avoid frustration by entering the address information in the appropriate boxes and by double-checking for typos and other errors as part of submitting your order.

If you give us incomplete or incorrect information, we may cancel your order without being liable for any damage or costs other than repayment of any amount received from you in relation to the order we cancelled, or we may make an additional charge of a reasonable sum to compensate us for any extra work that is required as a result. We will not be responsible for any delays in the processing or shipment of your order if this is caused by you not giving us complete or correct information.

If you fail to take delivery of your order and your order is returned to Wacom by one of our shipping partners, we will not re-arrange delivery to you of the products which are subject to the foregoing order, nor will we provide you with a refund. If you wish to purchase the products subject to the foregoing order, you will need to place a new order for such products.

Order Processing by Wacom

Our warehouse processes orders only during business hours from Monday through Friday, excluding any public holidays in Singapore.

Applicable Taxes

You are responsible for all governmental taxes with regard to your purchase including but not limited to any import duties that may be applicable. The prices for the Products displayed on our eStore are exclusive of any applicable governmental taxes.

Non-Refundable Shipping Fees

All shipping fees are non-refundable. For the avoidance of doubt, shipping fees cover the services provided by our shipping carrier and will not be refunded if a Product is returned for any reason whatsoever.

PAYMENT METHODS

Wacom accepts payments via the following methods:

  • Credit Card: Visa or Mastercard
  • Online Banking via Momo ATM (for Vietnam only)
  • Wallet Payments: Gcash Wallet (for Philippines only), Momo E-wallets (for Vietnam only), DANA Wallet (for Indonesia only) and Apple Pay (for Singapore only)

By making a payment by credit card or by other payment methods that are accepted by us, you represent and warrant that you are authorized to use the designated payment method and that you authorize us to charge your payment method for the total amount of your order (including applicable taxes and applicable shipping fees and other applicable fees). When you provide your payment information, you authorize us (or a third party service provider working on our behalf) to process, verify and store your payment information and other related information. If the payment method cannot be verified, is invalid or is otherwise unacceptable, your order may be suspended until you have successfully paid us the outstanding amount, or cancelled.

Please note that it may take up to three (3) Business Days to verify your payment. You are responsible to resolve any problem we or our third party service provider encounter in order to proceed with your order. In the event you want to change or update any payment information associated with your account, you can do so at any time by logging into your account and editing your payment information. If you had paid with a credit card, your credit card will be billed upon shipment of your order.

The invoice for your purchase will be automatically issued and sent to your registered e-mail address or the e-mail address that you provided during the order process, after you have successfully placed your order on our eStore. For the avoidance of doubt, the total amount stipulated in the tax invoice will be same as the total payment for your order.

RETURN, REFUND, EXCHANGE POLICY

To return your online purchase made from our eStore, please comply with the following requirements under this return policy (“Return Policy”):

Separate from any limited warranties that may be expressly offered by Wacom for certain hardware Products, Wacom also offers the following return policy on products purchased through our eStore.  Please note, however, that except as otherwise prohibited by applicable laws, we do not accept the return of software Products for which you have purchased a license or usage rights through the eStore, and except as otherwise prohibited by applicable laws, any and all licenses or usage rights for software that you purchase through the eStore are non-refundable and non-cancellable.

Singapore, Malaysia, Indonesia, Thailand, Vietnam and the Philippines

·         If the hardware Product is faulty or damaged and such faultiness or damage is due to reasons solely attributable to Wacom (“Damaged Product”), you must initiate the return of the product to us within 7 days from the date you received the product; or

·         If the hardware Product is materially different from what was indicated or advertised on our eStore at the time of your purchase (“Inaccurate Product”), you must initiate the return of the product to us within [7 days] from the date you received the product.

·         If the color of the hardware Product delivered is different from what you ordered or if you change your mind about the color of the product delivered to you, you must initiate the return of the product to us within 7 days from the date you received the product.

 

We do not accept the return of:

 

  • hardware Products that are faulty or have been destroyed or damaged due to reasons attributable to you; and

 

  • hardware Products that do not meet the requirements as stipulated in this Return Policy.

 

If you want to return your online purchase made from our eStore, please contact Wacom Customer Support at any of the numbers provided under Section “Payment Methods” of these Terms.

If you have completed your check out for your order as a “Guest”, please select your order number and the products you want to return on your order page or contact Wacom Customer Support via telephone at any of the numbers provided under Section “Payment Methods” of these Terms.

If you purchased a hardware Product bundle from Wacom, please note that the individual Products included as part of the bundle can only be returned if all of the Products making up the bundle offer are also returned.

For every return of a hardware Product, Wacom reserves the right to request from you any information that Wacom thinks necessary relating to such hardware Product and this includes, but not limited to, proof of the damage to the Damaged Product or misdescription of the Inaccurate Product.

All returns must be addressed to the place that the Wacom Customer Support designates.

Subject to this Return Policy, for the return of the products, you are only entitled to the following:

·       an exchange, if the product is a Damaged Product; color of the product delivered is different from what you ordered or if you change your mind about the color of the product delivered to you.

 

If you wish to change the size of a hardware Product or exchange the hardware Product you ordered with another hardware Product, you should submit a new order only after (1) you have successfully canceled your initial order; and (2) the processing for the refund of your initial order has been completed by us. No other methods of exchange is permitted apart from the foregoing. For our cancellation policy, please refer to the “Order Cancellations” Section below.

Return / Exchange Shipping Fees

If you are returning a Damaged Product or an Inaccurate Product, we will bear the relevant shipping fees, provided that the return of the hardware Product is conducted strictly in accordance with these Terms and the instructions of the Wacom Customer Support.

If you are requesting for an exchange of the hardware Product to a color which is different from your order because Wacom delivered the wrong color to you, the cost of the return of such product and the shipment of the order with the correct color will be at Wacom’s cost; or

If you are requesting for an exchange of the hardware Product to a color which is different from your order because you changed your mind, you must pay all shipping fees related to the return of such Product and the shipment of the order with the color of your choice.

If upon our inspection of the returned hardware Product, we are satisfied, in our reasonable opinion, that the product is:

  • not a Damaged Product or an Inaccurate Product;
  • faulty or damaged in any way due to reasons attributable to you; or
  • not returned in its original package,

we will not process your request for refund or exchange of the returned hardware Product and we will ship such returned hardware Products back to you subject to your payment of the shipping fees which we will separately notify to you without delay.

If you requested for a refund and upon inspection of the returned hardware Product, we have determined that your return meets the terms and conditions of this Return Policy, it will take us up to seven (7) Business Days to process your refund. Please allow up to seven (7) Business Days for your original payment method to be credited. If you made your payment through the online banking as your original payment method, it may take up to thirty (30) Business Days for the refund to be credited. If you do not receive your refund after thirty (30) Business Days, please contact your payment processor directly for further information.

Order Cancellations:

To the extent permitted by applicable laws, Wacom does not permit the cancellation of any order under any circumstances once the Product that is subject to that order has been processed for shipment; provided, however, that Wacom may, in its sole and absolute discretion, permit the cancellation of your order and refund you the total amount after deducting “Restocking Fee”, subject to (i) your requesting such cancellation within three (3) Business Days upon receiving the hardware Product, (ii) returning the hardware Product in unopened with the seal still intact and the packaging unbroken and brand new condition to Wacom at your own cost including any taxes or duties in accordance with Return Policy. For this section, “Restocking Fee” means 10% of your payment in case the hardware Product is delivered by Wacom to your address in Singapore, and 30% of your payment in case the hardware Product is delivered by Wacom to your address in Malaysia, Indonesia, Philippines, Thailand and Vietnam. If you are permitted by Wacom to cancel your order in accordance with the terms hereunder, you shall arrange for the return of such product in accordance with this Return Policy.

If you would like to request Wacom’s permission for cancellation of your order prior to it having been processed for shipment, please call Wacom Customer Support at any of the numbers provided under Section “Payment Methods” of these Terms.

Please have your order number ready prior to calling. Alternatively, if you hold a Wacom ID account, you can request Wacom’s permission for cancellation of your order from your order history page which is accessible via your account.

Other important information relating to cancellation are as follows:

  • If and after your order has been successfully canceled and you comply with all the terms of this Return Policy, we will process your refund after the relevant deductions set out hereunder and this may take time depending on the payment methods you used to pay for your order.
  • For payments made by Credit Card, the duration to process your refund will depend on the Credit Card issuing companies. For payments made by online banking, the amount paid after the relevant deductions set out hereunder will be refunded to your bank account.
  • We will cancel your order and refund the full amount paid by you if a product you ordered is not in stock.

Please note, however, that as noted above and except as otherwise prohibited by applicable laws, we do not accept the cancellation of purchases of software licenses or usage rights, and any and all licenses or usage rights for software that you purchase through the eStore are non-cancellable.

LIMITED WARRANTIES

For individual Wacom products, Wacom warrants those products pursuant to the terms of the limited warranty that accompanies the product. Please refer to Wacom Support page for more information.

Wacom software, if any, is licensed "AS IS" and with all faults. Wacom makes no warranty with respect to its quality or performance. Wacom cannot guarantee you uninterrupted service or the correction of any errors.

Wacom does not itself warrant any third party Products sold through the eStore.  Rather, the sole warranty for any such third party Product is the warranty provided by the applicable manufacturer or provider of the Product and that accompanies the Product or that is provided as part of the Product Specific Terms for the Product.  Wacom may, in its discretion, provide reasonable assistance to you in making any warranty claims against the applicable manufacturer or provider. 

 

ADDENDUM

A.    Additional Provisions Applicable to Malaysia Only

 

None.

 

B.    Additional Provisions Applicable to Thailand Only

 

None.

 

C.    Additional Provisions  Applicable to Indonesia Only

 

1.     The provisions of Paragraph C of this Addendum shall only apply to users accessing the Wacom eStore from Indonesia.

 

2.     In compliance with Indonesian Law No. 24 of 2009 on Flag, Language, National Emblem, and National Anthem, these Terms shall be prepared in both Indonesian language and the English language version which shall both be effective. In the event of any inconsistency between the Indonesian language and English language texts or should there be any dispute on the meaning or interpretation of certain provisions, the English language text shall prevail and the Indonesian language text will be deemed to be amended to conform with and to make the relevant Indonesian language text consistent with the relevant English language text.

 

D.    Additional Provisions  Applicable to Vietnam Only

 

1.     The provisions of Paragraph D of this Addendum shall only apply to users accessing the Wacom eStore from Vietnam.

 

2.     Section 8 of the Terms is replaced in its entirety by “These Terms are governed by and construed in accordance with the laws of Singapore provided that the laws of Singapore does not adversely affects the minimum benefits of the employee or consumer as provided in the law of Vietnam.  You agree to submit to the personal and exclusive jurisdiction of the courts located in Singapore, and agree you will not  object to such jurisdiction or venue on the grounds of lack of personal jurisdiction, forum non conveniens or otherwise.”

 

E.    Additional Provisions Applicable to the Philippines Only

 

1.     The provisions of Paragraph E of this Addendum shall only apply to users accessing the Wacom eStore from the Philippines,

 

2.     Any warranty provided by Wacom is not transferrable without the consent of Wacom in writing.
